Gov. Brown pushes $23-billion plan to tunnel under delta

Gov. Jerry Brown's administration said Wednesday that it is pushing ahead with a $23-billion proposal intended to improve water deliveries to the San Joaquin Valley and Southern California and stop the ecological free fall of the Sacramento-San Joaquin Delta.

The plans, which would involve construction of the most ambitious water supply project in California in decades, call for the building of two massive tunnels beneath the delta to transport water south, and the restoration of tens of thousands of acres of delta habitat.

Invoking California's "pioneer spirit," Brown said the project was "profoundly important to California's future" and called it "a big idea for a big state."

"I look at this as another test of whether we can govern ourselves," he said at a Sacramento news conference, at which he was joined by U.S. Interior Secretary Ken Salazar. "Analysis paralysis is not why I came back. I want to get [stuff] done," he said, using an expletive to emphasize his resolve.

Under the proposal, which is a scaled-down version of an earlier design released during Gov. Arnold Schwarzenegger's administration, three large intake facilities would be built on the Sacramento River near Hood. They would be capable of diverting 9,000 cubic feet of water a second into two side-by-side underground tunnels that would carry supplies 35 miles to the huge government pumps in the south delta that send water to Central Valley farms and Southland cities. Currently, supplies are drawn through the delta to the pumps, a system that has profoundly altered the delta ecology.

Water users ? ultimately farmers and residential customers ? would foot the $14-billion construction bill and roughly $5 billion in operating costs. State taxpayers would cover most of the $3-billion to $4-billion expense for habitat restoration.

Though Brown's announcement signaled momentum after years of planning, the proposal remains far from a sure thing. Key issues remain unsettled ? most important, the volume of water that would be exported from the delta system.

If the water agencies paying for the new conveyance facilities can't be assured of the deliveries they want, they could pull out. The project must also win permits from the state and federal agencies responsible for enforcing endangered species protections.

Officials said alternatives, including building larger or smaller facilities, will remain under consideration while they try to nail down details of their preferred proposal in coming months. They are hoping to release draft environmental documents this fall and issue a final decision next year. Under the most optimistic time frame, construction could begin in two to three years, and the project would be up and running in 2026.

The tunnel proposal echoes the peripheral canal project that Brown, in an earlier term as governor, pushed through the Legislature, only to see it killed by voters in 1982. Brown said the new project is based on a much better understanding of the delta ecosystem and the effects of delta pumping. "Here we are 30 years later with a lot more knowledge, a lot more science and better technology," he said.

The plan for a new system to ship Northern California water supplies south is the latest in 20 years of efforts to resolve the conflict between the state's thirst and the environment of the West Coast's largest estuary.

As water exports rose in recent decades, the health of the delta has deteriorated sharply. Its native fish are imperiled, its waters infested with invasive species. The delta's basic hydrology has been thrown out of whack by the enormous south delta pumps that are so powerful they reverse the flow of delta waterways.

With environmental decline have come tighter export restrictions that cut water deliveries to the Southland and San Joaquin Valley agribusiness. The premise of the new proposal is that by combining new conveyance facilities with extensive habitat restoration, the delta environment will improve, fish species will rebound and water deliveries will stabilize or grow.

But environmentalists and delta advocates argue that the only way to save the delta is to take less water from it. "They can't prove [the project] will work for the environment," said Jonas Minton, a former state water official who is now water policy advisor for the Planning and Conservation League. The estuary "needs more fresh water to sustain it, and they continue to deny that," he added.

The proposal to build a peripheral canal around the delta to carry supplies to the pumps sparked a nasty north-south battle 30 years ago.

But political opposition to the tunnel proposal has so far been centered in the delta, which has limited political clout and has aimed its guns at corporate agriculture rather than Southern California ? recognition that most of the water diverted from the delta goes to irrigation ditches, not urban faucets.

The commercial salmon industry worries that the big intakes will harm migrating salmon on the Sacramento River. Delta farmers are concerned that a reduction of the river's flows into the delta will hurt their water quality. And they don't want to lose fields to wetlands restoration.

After the morning news conference, a bipartisan group of about 200 farmers, fishermen and lawmakers from the delta region, some holding pitchforks and homemade signs, gathered on the steps of the state Capitol to blast the proposal. "To the governor and the secretary ? you launch a war, we'll fight the battle," declared Rep. John Garamendi (D-Walnut Creek).

In Washington, Rep. Jerry McNerney (D-Pleasanton) called the plan "completely unacceptable," and Rep. Mike Thompson (D-St. Helena), who represents fishing communities, said it was a "terrible mistake to outline what it is that they prefer happens before the science is done to determine what can and should happen."

In statements, officials of the Metropolitan Water District of Southern California and the Westlands Water District ? which together would pay for about half the cost of the intake-tunnel system ? called Brown's announcement a milestone.

But Westlands raised the possibility that some water users could ultimately decide the program wasn't worth their investment. And in an interview earlier this week, an official of the Kern County Water Agency was similarly cautious.

"This isn't affordable at all costs for our water users," said Jim Beck, the agency's general manager. "In the next few months, we hope we get more information that would help them make an informed decision about the viability of the project for them and our willingness to continue funding our share of the permitting effort."

Driving through the entrance to a historic, prestigious and wonderfully maintained course, Jon Wright knew he needed to quit golf.

That was nearly a decade ago, when coming to The Country Club of Salt Lake City every day to play and practice in the interest of advancing his pro career was becoming a chore.

"I dreaded it. I hated it," Wright was saying Sunday afternoon, having happily moved on to another stage of his life in golf. "I didn?t like playing. I didn?t like practicing. I didn?t like traveling. I didn?t even like the tournaments. When that starts to happen, you know you?re on our your way out. It was pretty apparent ? I was burned out."

And with that, his long quest to qualify for the PGA Tour ? a demanding process that kept teasing him and breaking his heart ? was over.

"Honestly," Wright said, "I just wasn?t good enough. So I?m where I belong."

Which was standing on the club?s patio, holding the State Amateur trophy after a 3-and-2 victory over Christian Jensen in Sunday?s 36-hole final match. The trophy fell off a table and broke the other day, requiring repair work.

That fits Wright?s story, as a reinstated amateur who?d once had enough of golf. He grew up loving the game at Bonneville Golf Course, where he was raised along the old No. 5 fairway, and The Country Club, where his family became members when he was 15. He?s played 2,000 rounds on this exclusive course, by his rough estimate.

"Obviously," Jensen said, "that?s going to be a good advantage to anybody."

Wright, 41, made his local knowledge work for him, playing as aggressively as he does in those Wednesday and Friday contests with 15 or 20 of the club?s better players.

Jensen, the other four golfers Wright eliminated in match play and the guys he occasionally beats in those money games can blame Bryan Bagley for all of this. As a former sponsor of Wright?s pro golf pursuits, Bagley encouraged him to come back and play in 2006, after a couple of years away.

Driving into that same parking lot that evoked frustration and drudgery, Wright suddenly felt different. "It?s going to be fun," he said to himself.

And that?s how he played Sunday. He blasted a ball over the trees that frame the left side of the par-4 No. 11, where his drive traveled the equivalent of nearly 350 yards, leading to a birdie.

That shot was illustrative of a golfer who?s playing for fun now, as opposed to playing for a living. That?s not to say there was no pressure on Wright, considering the expectations of club members, who kept driving that point home "every day since the course opened in March," he said.

A son of the late Bob Wright, the runner-up to Scott Matheson in the 1980 Utah governor?s race, Wright himself once was chasing politics and the PGA Tour at the same time. Campaigning during the 2002 tour qualifying process, he lost to Greg Curtis as a Democrat seeking a Utah House seat from Sandy.

That bid was part of his determination, as he said then, "to not base your success or failure in life on whether that stupid ball goes in the hole."

Yet when that happened for the last time Sunday, Wright was thrilled. Nobody grows up dreaming of making a tough putt for a bogey to win the State Am, but Wright did not care about that circumstance. All that mattered was he made it, completing his victory on a classic course where golf is fun again.

Essar Oil raise Rs 5000 cr via bank loans to pay tax dues

Essar Oil has said it has tied up credit arrangements of around Rs 5,000 crore from Indian banks to pay its sales tax dues of Rs 6,169 crore to the Gujarat government.

The company continues to pursue the matter of repayment schedule of its sales tax liability both legally and with the State Government. Essar Oil is confident that with this facility tied up it will be in a position to meet its entire payment obligations, the company said in a statement.

Lalit Gupta, managing director and CEO of Essar Oil, said: "The new loan facility will enable EOL to meet its sales tax liability. Our lenders have continued to be very supportive of the business, which remains well placed given the demand for high value fuels both in India and internationally."

Earlier this year, the Supreme Court had rejected Essar Oil's review petition, making it necessary for the company to pay the amount (in excess of $1 billion) in tax levies to the Gujarat government.

The Gujarat government had started taking coercive steps over the last few weeks, seeking its dues. Essar had then approached the Supreme Court again.

Last week, the Supreme Court asked Essar Oil to pay Rs. 1,000 crore to the Gujarat government towards sales taxVAT dues by July 30th.

Essar Oil has already recognised this liability in its quarterly accounts for the quarter ended Dec 31, 2011.

(AP) ? A potential exodus of star athletes. No hope of playing in the postseason. More than a decade of accomplishments erased from the record books. And Joe Paterno's legacy in shreds.

Penn State football, a longtime powerhouse that was once one of the cleanest, most admired programs in college sports, escaped the so-called death penalty from the NCAA on Monday but was dealt a heavy blow that will cripple it for years to come.

The university agreed to an unprecedented $60 million fine, a four-year ban from postseason play and a cut in the number of football scholarships it can award ? the price it will pay for having looked the other way while Jerry Sandusky brought boys onto campus and molested them.

The NCAA also erased 14 years of victories, wiping out 111 of Paterno's wins and stripping him of his standing as the most successful coach in the history of big-time college football.

"Football will never again be placed ahead of educating, nurturing and protecting young people," NCAA President Mark Emmert declared.

Penn State meekly accepted its punishment, pledging to hold itself to high standards of honesty and integrity.

Penn State spokesman David La Torre said university President Rodney Erickson had no choice but to acquiesce, given the threat of a total shutdown of the football program.

"It was clear Penn State faced an alternative ? a long-term death penalty and additional sanctions for the program, university and whole community. Given the situation, he believed the sanctions offered and accepted was the appropriate and course of action," La Torre said.

At a student union on campus, several dozen alumni and students gasped, groaned and whistled as they watched Emmert's news conference. The news was a crushing blow to many students.

Nicole Lord, a senior, questioned why Penn State's student body, and especially its athletes, should be punished "for the wrongs of three men and a monster."

"They keep breaking our hearts and breaking our hearts and breaking our hearts," she said.

Sandusky, a former member of Paterno's coaching staff, was found guilty in June of sexually abusing 10 boys over 15 years, sometimes on campus. An investigation commissioned by the school and released July 12 found that Paterno, who died of lung cancer in January at age 85, and three other top officials at Penn State concealed accusations against Sandusky for fear of bad publicity.

The NCAA's punishment was announced a day after the school took down a statue of Paterno that stood outside Beaver Stadium.

The sanctions will make it difficult for the Nittany Lions to compete at the sport's highest level. Raising the specter of an exodus of athletes, the NCAA said current or incoming football players are free to immediately transfer and compete at another school.

For a university that always claimed to hold itself to a higher standard ? for decades, Paterno preached "success with honor" ? Monday's announcement completed a stunning fall from grace.

Paterno's family said in a statement that the sanctions "defame the legacy and contributions of a great coach and educator."

"This is not a fair or thoughtful action; it is a panicked response to the public's understandable revulsion at what Sandusky did," the family said.

Emmert said the penalties reflect "the magnitude of these terrible acts" and also "ensure that Penn State will rebuild an athletic culture that went horribly awry."

He said the NCAA considered imposing the death penalty, or a complete shutdown of football for a season or more, but worried about the collateral damage.

"Suspension of the football program would bring with it significant unintended harm to many who had nothing to do with this case," Emmert said. "The sanctions we have crafted are more focused and impactful than that blanket penalty."

Gov. Tom Corbett expressed gratitude that Penn State escaped the death penalty, saying it would have had a "severe detrimental impact on the citizens of State College, Centre County and the entire commonwealth of Pennsylvania."

A drop-off in attendance and revenue could damage both the university, where the football team is a moneymaker that subsidizes other sports, and much of central Pennsylvania, where Saturday afternoon football at Penn State is an important part of the economy.

But given Penn State's famously ardent fans and generous benefactors, the precise economic impact on Penn State and Happy Valley, as the surrounding area is known, remains unclear.

First-year coach Bill O'Brien, who was hired to replace Paterno, will have the daunting task of trying to keep players from fleeing the program while luring new recruits.

"I knew when I accepted the position that there would be tough times ahead," O'Brien said.

Already, at least one recruit, Ross Douglas, a defensive back from Avon, Ohio, backed out of his commitment. Douglas told Rivals.com on Monday: "We prepared ourselves for it, and today was just the icing on the cake. I love Penn State to death, but I have to do what's best for me, and I'm going to look elsewhere."

Separately, the Big Ten announced that Penn State will not be allowed to share in the conference's bowl revenue during the NCAA's postseason ban, an estimated loss of about $13 million.

Emmert fast-tracked the penalties rather than go through the usual circuitous series of investigations and hearings.

The NCAA said the $60 million fine is equivalent to the annual gross revenue of the football program. The money will go toward outside programs devoted to preventing child sexual abuse or assisting victims.

Penn State said it will pay the fine in five annual installments of $12 million. The governor demanded assurances from Penn State that taxpayer money will not be used to pay the fine; Penn State said it will cover it with its athletics reserve fund and capital maintenance budget and, if necessary, borrow money.

By throwing out all Penn State victories from 1998 to 2011, the NCAA stripped Paterno of the top spot in the record book. The governing body went all the way back to 1998 because, according to the investigative report, that is the year Paterno and other Penn State officials first learned of an allegation against Sandusky.

Former Florida State coach Bobby Bowden will replace Paterno with 377 major-college victories, while Paterno will be credited with 298.

"I didn't want it to happen like this," Bowden said. "Wish I could have earned it, but that's the way it is."

Penn State will also lose 20 scholarships a year for four years. Major college football programs are normally allowed 85 scholarship players per year.

The postseason ban is the longest handed out by the NCAA since it gave a four-year punishment to Indiana football in 1960.

Penn State players left a team meeting on campus in State College without talking to reporters. Penn State's season starts Sept. 1 at home against Ohio University.

"Our heritage, our legacy has been tainted and damaged," said Troy Cromwell, a wide receiver on the 1986 team that won the second of Paterno's two national championships. Romanian PM Cleared of Plagiairizing His PhD :: Balkan Insight

Romania's National Ethics Council, an Education Ministry panel, announced late on Thursday that Prime Minister Ponta did not plagiarize his PhD thesis, saying that it was written in accordance with the academic standards of the time it was published.

The board said that Ponta followed the rules prevailing in 2003, when he completed his doctoral thesis on the International Criminal Court.

?The decision of the Ethics Council is a definitive one and says that the case is closed?, Education Minister Ecaterina Andronescu said on public television. Andronescu is a member of Ponta's ruling Social Democratic Party, PSD.

The announcement may not end disputes over Ponta's PhD, however, as various bodies are in charge of checking the authenticity of scientific works.

In June, the National Council for Attesting Titles, Diplomas and University Certificates, CNADTCU, a body working under the umbrella of the Romanian Academy, said that Ponta did plagiarize large sections of his thesis and called for him to be stripped of his PhD.

A third panel, set up by the University of Bucharest, which granted Ponta his degree, is due to deliver its report on the plagiarism allegations on Friday.

Plagiarism and other forms of academic dishonesty are endemic in Romania. After the overthrow of the Communist regime in 1989, a large number of private universities and institutes opened, offering what some say were illegitimate? academic qualifications.

Ponta, who said his only mistake in writing his thesis was not to credit all the sources in the footnotes, but only in the bibliography, insists that the charges were politically orchestrated by his rival, Romania's now suspended President, Traian Basescu.

For weeks, Romania has been moving towards a showdown between Basescu and Ponta, with both jockeying for power.

The parliament, where Ponta's leftist coalition has a majority, on July 6 voted to suspend Basescu as President for 30 days and announced that a referendum will take place as next stage of a campaign to impeach him.

    Media Arts Center San Diego is now accepting submissions for our 4th annual Film Festival Poster Competition. The deadline for all submissions is October 5, 2012.

    Media Arts Center San Diego will be celebrating ?their 20th Annual San Diego Latino Film Festival (SDLFF), March 7-17, 2013 and for the 4th year in a row will hold its film festival competition. ?The San Diego Latino Film Festival (SDLFF) celebrates films and videos by Latinos and/or about the Latino experience, screening over 150 works from across Latin America and throughout the United States.

    Guidelines:?The competition is open to all artists and graphic designers. All submissions must be received by the deadline of October 5, 2012 at 5:00pm. There is no limit to the number of submissions entered.?There is no cost to submit. Entries will be accepted from individuals, collaborative teams, or design firms, with prize money being split between the entrants listed. No additional prize money will be awarded.

    We are looking for images that depict Latin American Cinema in an interesting, relevant and visually innovative way that avoids stereotypes and cliches. Entries will be judged using the following criteria:

    *Overall impact of the display for eye-catching appeal, visual attractiveness, and its ability to draw the viewer in

    *Clarity of the message?s demonstration of Latino cinema/film festival

    *Appropriateness of the graphics for the festival

    *Creativity

    *Entries must be mounted on an 8 1/2? w x 11? h board.

    Late submissions will NOT be accepted.

    In the artwork, be sure to include ?20th Annual San Diego Latino Film Festival, March 7-17, 2013? Entries may be in the form of photography, painting, graphic art, and illustration, in color or black and white. The design should be easy to translate into a range of print materials such as 30? x 36? size posters, newsprint ads, t-shirts, film, street banners, bus advertisements, etc.

    Place your name, address, email and phone number on the back of each submission. All submissions will be judged based on content, appeal and marketability. The decisions of the judges will be final. Media Arts Center San Diego does not take on liability for submissions. Please provide a self-addressed stamped envelope if you would like your design(s) to be returned to you.

    All submissions become the shared property of the artist and San Diego Latino Film Festival. By submitting an entry, the entrant agrees that San Diego Latino Film Fesitval has permission to use the image for purposes including, but not limited to:
